Privacy Statement and Consent to Data Processing by Lensvision

Therefore, the protection and lawful collection, processing, and use of your personal data is an important matter to us. So that you feel safe when visiting our websites, we strictly observe the statutory regulations when processing your personal data and here we would like to inform you about how we collect and use data.
This privacy statement is an integral part of the terms and conditions of Lensvision. By accepting the terms and conditions, this privacy statement will also be understood to have been accepted. We reserve the right to make changes to these terms and conditions. 3. Collection of Personal Details and Use of Data
You can visit the LENSVISION website at any time without disclosing your personal details.
When visiting our website, our servers temporarily save each access in a log file. The following data will be collected without your input and stored by us for a maximum of twelve months, until it is deleted automatically:
the IP address of the inquiring computer
the date and time the website was accessed
the name and URL of the requested file
the website from which our website was accessed
the operating system of your computer and the browser used
the country you are accessing from
the name of your internet access provider
The collection and processing of these details will be carried out for the purpose of enabling the use of our website (establishing a connection), guaranteeing permanent system safety and stability, and enabling our internet offer to be optimised, as well as for statistical purposes. The IP addresses will only be analysed when the network infrastructure of lensvision.ch is attacked and for statistical purposes.
We collect, save and process personal details solely in accordance with the statutory regulations and only when it is necessary to do so for the fulfilment of the contractual obligations between us and the user, or to supply the products on our websites. This also includes the storage of data for any warranty claims once the contract has been fulfilled.
We will also use your details within the framework of the applicable law for our own marketing purposes, to optimise our online offer, make your shopping experience with us more comfortable and individual, and to make customers aware of products that may be of special interest to them.
Moreover, personal details are only collected, processed or used provided that you have given your consent.

4. Use of Your Data for Marketing Purposes
a) Sending of newsletters
When subscribing to the newsletter, your email address will be used for advertising purposes respectively customer specific advertisements at Lensvision or at selected partner shops, until you unsubscribe from the newsletter. You can unsubscribe at any time. We are entitled to assign third parties with the technological handling of advertising activities and have the right to pass on your details for this purpose.
b) Service and product information
When we receive your email address during an order placement for goods at our web shop, we will use your email address to inform you via service and product information emails about similar products that may be of interest to you. However, we will only use your email address for this purpose if you have not disagreed to us doing so. You can disagree at any time.
c) Customer account
For every customer that registers accordingly, we will enable password-protected, direct access to their order details that are stored by us (customer account). Here, you can see details about completed, open and recently dispatched orders, and manage details. You agree to treat personal details confidentially and to not make them accessible to unauthorised persons. We cannot assume any liability for the improper use of passwords, unless we are at fault.
Information, deletion and correction
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if necessary, a right to correction or deletion of this data. 5. Passing on of Information to Third Parties
We disclose your personally identifiable information only, if you have expressly consented, if there is a legal obligation for us to do so, or if it is necessary to enforce our rights, in particular for the enforcement of claims arising from the contractual relationship. In addition, we disclose your data to third parties, insofar as this is necessary prior to the conclusion of a contract or for reasons of implementing a contract. LENSVISION is entitled to pass on your personal details to third party companies abroad, provided that this is necessary for the execution of the contract, or that this takes place within the framework of the tracking and targeting measures mentioned in Item 10. These are subject to data protection to the same extent as the provider. If the level of data protection in a country is not the same as in Switzerland, we will contractually ensure that your personal details will be protected to the same extent as they are in Switzerland.
7. Encryption of Sensitive Data
We will protect your data transfer by means of a secure SSL connection. SSL (SSL encryption) is a security technology that ensures that your personal details, including credit card details, login details, and your preferred payment method, are transferred safely over the internet. The data is encrypted so that it can only be read by the payment system.
8. Credit Assessment
If we provide a service in advance, for example in the case of a purchase on account, we will obtain a credit report from a credit agency based on mathematical and statistical processes in order to protect our legitimate interests, if necessary. For this, we will provide a credit agency with the personal details required for a credit check and we will use the information we receive about the statistical probability of a payment default in order to make a decision for the drafting, execution or termination of a contractual relationship. The credit report can include probability values (score values) that are calculated based on recognised mathematical and statistical processes and incorporate address details, amongst others, during the calculation. Your legitimate interests will be considered in accordance with statutory regulations.

We use the “conversion pixel“ of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). This enables us to follow the activities of users after they have seen or clicked on a Facebook advert. In doing so, we can assess the effectiveness of the Facebook adverts for statistical and market research purposes. Data collected this way is anonymous; in other words, we do not see the personal details of individual users. However, these details will be stored and processed by Facebook and we will inform you of this according to our level of knowledge. Facebook may link this data to your Facebook account and use it for their own advertising purposes, in accordance with Facebook’s data use guidelines https://www.facebook.com/about/privacy. You can enable adverts from Facebook and their partners to be displayed on and outside of Facebook. Moreover, a cookie can be stored on your computer for this purpose. 13. Right to Disclosure, Deletion and Correction
Customers can request to view personal details about them that are stored by LENSVISION or view these and change them themselves by logging into the website. They have the right to view, correct, block, and delete the details about them that are stored at any time. A deletion of the data can be requested at any time, provided that there are no statutory regulations stipulating that it must be stored.
